SophiesPick
Terms of Service
Effective date:
1. About SophiesPick
SophiesPick is a browser-based poker service operated by Carlos Hurtado (“SophiesPick,” “we,” “us”). These Terms describe the conditions for using our website, games, Match Play, Clubs, and Events.
Please read these Terms before participating. If you do not agree, do not use the service. Our Community Rules also apply to participation. Our Privacy Policy explains how we handle personal information.
Contact: support@sophiespick.com.
2. Eligibility
SophiesPick’s initial beta is intended only for players in the United States. You must be at least 18 years old and legally an adult where you live. Use the service only where your participation is lawful.
Access to the website does not mean participation is permitted in every state. We may restrict access where necessary for legal, security, or operational reasons.
3. Free play only
SophiesPick uses virtual play chips solely for entertainment. Chips cannot be purchased or redeemed through the service and have no monetary value. We do not offer real-money deposits, withdrawals, rake, cash prizes, or financial redemption.
You must not buy, sell, or exchange chips or accounts for money or anything of value. You must not use SophiesPick to arrange or conduct wagering, including settling game results outside the platform through cash, payment applications, cryptocurrency, or other transfers of value.
Ratings, statistics, and rankings measure gameplay performance. They do not create a right to money, prizes, or future benefits.
4. Accounts and guest participation
Provide accurate information where requested and use only accounts you are authorized to access. Keep sign-in links and session credentials private. Notify us if you suspect unauthorized access.
Do not impersonate others, share an account to manipulate results, evade restrictions, or use multiple accounts or guest identities to gain an unfair advantage.
Guests must follow the same eligibility and conduct rules as registered users.
5. Fair play and prohibited conduct
Do not cheat, collude, disclose private live-hand information to assist another player, manipulate ratings, deliberately exploit errors, or use unauthorized automation or real-time assistance to gain an unfair advantage.
Do not harass, threaten, discriminate against, defraud, or expose private information about others. Do not upload unlawful content, malicious software, or material that infringes another person’s rights.
Do not attempt unauthorized access, interfere with service availability, or bypass access controls or restrictions.
6. Clubs and organizers
Organizers are responsible for their Club rules, invitations, uploaded content, and use of organizer permissions. Club rules must be consistent with these Terms and our Community Rules.
Organizers must not collect stakes, charge wagering-related fees, offer prizes tied to game outcomes, or arrange outside settlement of results. They must use moderation powers fairly and protect information available through their role.
A Club’s availability on SophiesPick does not mean we endorse its organizer or content. Report suspected violations to support@sophiespick.com.
7. Content and intellectual property
You retain ownership of content you submit. You must have the rights and permissions needed to share it.
You grant us a nonexclusive, worldwide, royalty-free license to host, store, reproduce, resize, and display that content as reasonably necessary to operate, secure, and moderate the service. This includes making it available to the audience you select through the relevant feature. Retained copies are handled as described in our Privacy Policy.
SophiesPick’s software, branding, and other service materials belong to their respective owners. Using the service does not transfer ownership of those materials to you.
8. Beta availability and resets
SophiesPick is a beta service. Features may change or be discontinued, and errors or interruptions may occur. We do not guarantee uninterrupted access, continued feature availability, or preservation of every game or record.
We may reset accounts, virtual chips, histories, statistics, or ratings for testing, maintenance, integrity, or service changes. We will give advance notice of planned resets when reasonably possible.
A gameplay reset is not necessarily deletion of all associated personal information.
9. Moderation, suspension, and termination
We may investigate reports, remove content, correct manipulated results, restrict features, or suspend or terminate access for violations, security concerns, legal obligations, or operational necessity.
We do not monitor every interaction or guarantee that every violation will be detected. Action may be taken without advance notice when reasonably necessary.
To request review of a moderation decision, email support@sophiespick.com with relevant details. You may stop using the service at any time and contact us about account closure or privacy requests.
10. Disclaimers and liability
To the extent permitted by law, the beta is provided “as is” and “as available,” without warranties of uninterrupted operation, error-free performance, or suitability for a particular purpose.
To the extent permitted by law, we are not liable for indirect or consequential losses resulting from use of or inability to use the service, including lost profits or opportunities.
Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, gross negligence, or any liability or consumer right that applicable law does not allow us to exclude or limit.
11. Disputes
You may contact support@sophiespick.com to seek an informal resolution. Contacting support is not a condition of exercising your legal rights and does not extend legal deadlines.
These Terms are governed by New York law, except where mandatory law provides otherwise. Nothing here removes consumer protections or access to courts available under applicable law.
12. Changes
We may update these Terms and will post the revised version and effective date. We will provide additional notice and obtain agreement where legally required.
Changes do not retroactively remove accrued rights. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
